Florida Paternity & Father's Rights
Establishing Paternity in Florida
In Florida, a child born outside of marriage has no legal father until paternity is established. That means no enforceable legal rights or obligations, although once paternity is established the court can order child support going back up to 24 months before the case was filed. Establishing paternity creates a path to:
- Timesharing (custody/visitation)
- Parental responsibility (decision-making authority)
- Child support and financial obligations
- Inheritance, insurance, and military benefits
- Stability and legal identity for the child
Whether you’re a father seeking rights or a mother seeking support, we help you file, defend, or enforce paternity actions in court, with calm guidance and sharp legal strategy.
Legal Steps to Fatherhood
How Paternity Can Be Established in Florida
Under Florida law (including Florida Statutes Section 742.10), paternity can be established by:
-
Marriage
- If the parents are married when the child is born, paternity is presumed.
-
Voluntary Acknowledgment
- Both parents can sign a legal Acknowledgment of Paternity, usually at the hospital or later through the Florida Bureau of Vital Statistics.
-
Department of Revenue Order
- In some child support cases, the Florida Department of Revenue can establish paternity administratively. Like an acknowledgment, this does not create a parenting plan or time-sharing schedule.
-
Court Order
- When paternity is contested or not acknowledged voluntarily, either parent can file a Petition to Establish Paternity. The court may order DNA testing and ultimately issue a binding legal order.
What the Court Can Decide in a Paternity Action
- Legal fatherhood (with or without genetic testing)
- Parenting Plan : including timesharing and parental responsibility
- Child Support : calculated using the same Florida guidelines as divorce
- Healthcare, daycare, and education cost sharing
- Back child support (retroactive up to 24 months before filing)
- Child's birth certificate update (name change or father's name)

Florida Divorce FAQ
Paternity FAQ
No. You must be legally recognized as the child’s father before the court can issue a Parenting Plan or timesharing order.
Not always. If both parents agree, it may be waived. But if paternity is disputed, the court may order testing before proceeding.
You may be able to file a Petition to Disestablish Paternity under specific rules. Timing is critical; do not delay.
Many uncontested paternity cases resolve in about 60 to 90 days, but that is a typical range, not a promise. Contested cases or those requiring testing can take longer.
