Child Support
Child Support in Northwest Florida
Child Support Is About More Than Just Numbers
Support should be fair, accurate, and based on real life, not guesswork.
When children are involved in a divorce or separation, financial stability becomes critical. Florida law requires that both parents contribute to a child’s support, based on a formula, but the process isn’t always as simple as plugging in numbers.
At Justin Andersson, P.A., we help ensure your support obligation (or award) is fair, accurate, and enforceable, and that the outcome reflects your real financial situation and your child’s true needs.
Getting the Numbers Right
How Florida Calculates Child Support
Florida uses a statutory formula under § 61.30, based on:
- Net monthly income of both parents
- Number of overnights each parent has under the Parenting Plan
- Childcare, health insurance, and uncovered medical expenses
- Other allowable deductions (taxes, union dues, etc.)
Support Starts with Truth
What Counts as Income?
- Wages and bonuses
- Self-employment or gig income
- Disability or unemployment payments
- Rental income
- Retirement or pension payouts
- Recurring gifts or passive income
- Imputed income (what someone should be earning)
When Support Gets Complicated
Common Issues We Help Resolve
- Undisclosed income or cash-based jobs
- Self-employed parents with complex finances
- Modifications after job loss or income change
- Healthcare & extracurricular costs disputes
- Credit for overnights when not reflected in previous orders
- Enforcement of unpaid or delinquent child support
- Coordinating wage garnishment or automatic income withholding
Support That Adapts to You
Modifying Child Support
Life changes, and support orders may need to change with it.
You can request a modification if there is:
- A 15% or $50 difference from the original order
- A substantial change in income (job loss, raise, new child, etc.)
- A change in parenting time or custody
- A major change in the child’s needs (medical, school, special care)
Fairness in Child Support
Enforcement Options
If child support is unpaid or delinquent, we can help enforce the order through:
- Income withholding orders
- Contempt proceedings
- Driver’s license suspension
- Interception of tax refunds
- Court sanctions and wage garnishment
Florida Divorce FAQ
Child Support FAQ
No. Child support is the child’s right, not the parents'. Courts must approve any deviation from the guidelines and only do so under rare circumstances.
We can file a motion for contempt or enforcement, and the court has several tools to collect.
Support ends at 18 unless the child is still in high school with a reasonable graduation date before age 19.
